Terms & Conditions

Overview

These terms apply whenever you use Cybernaut Studio (Pty) Ltd's ("Cybernaut Studio", "we", "us") Website as a Service to build, host, and maintain a website for your business ("you", "the client"). By paying the setup fee or messaging us to get started, you agree to these terms.

These terms cover our standard packages: Static Starter, WordPress, and WooCommerce. Custom software projects are covered separately, see Bigger, custom projects below.

The service

Website as a Service is a done-for-you package: we design and build a mobile-first website for your business, then keep it running for a flat monthly fee. Depending on the package you choose, this includes:

  • A domain, registered in your name, you own it, not us
  • Fast, secure hosting
  • Business email addresses (the number included depends on your package)
  • SSL and security, handled automatically
  • A working contact form
  • Basic on-page SEO and AIO, and Google Business Profile setup
Exact inclusions and pricing vary by package. See our Services page or your specific package page (Static Starter, WordPress, WooCommerce) for the current price and scope of what you're signing up for. Add-ons are priced separately and only apply if you request them.

Pricing & payment

Pricing for each package is shown clearly on the relevant package page at the time you sign up, and covers domain, hosting, email, and support as described for that package. Add-ons are billed at the rates shown on our Services page at the time you request them.

Payments are processed securely through PayFast. The monthly fee is billed as a recurring subscription; you'll be charged automatically each month until you cancel. We may adjust pricing for new sign-ups from time to time, but we won't change what you're already paying without telling you first.

Getting your site built

Once you've paid the setup fee, we'll ask you for the content we need, your logo, business details, photos, and any text you want on the site. How quickly your site goes live depends largely on how quickly you can get us this information; a typical build takes days once we have what we need, not weeks.

You'll get a chance to review the site before it goes live, and we'll make reasonable adjustments based on your feedback as part of the initial build.

Domain & ownership

Your domain is registered in your name, not ours, it's yours. If you ever leave, you keep it and, on request, we'll help you export your content so you're never locked in.

Hosting, email, and the underlying infrastructure are provided and managed by us as part of the monthly fee, for as long as your subscription is active.

Changes & small updates

What's included in your monthly fee depends on your package, see your package's page for specifics. Larger changes, new pages beyond your starting scope, new features, or a redesign, are quoted separately, in line with our published add-on pricing or a custom quote for bigger work.

Cancellation

There's no lock-in. You can cancel your monthly subscription at any time by messaging us, no long notice periods, no cancellation fees, and no questions asked. Your site and email will stay live until the end of the billing period you've already paid for. See our Refund Policy for how refunds work.

Bigger, custom projects

Work beyond our standard packages, custom web apps, mobile apps, client portals, or full custom platforms, falls outside this package structure. That kind of work is scoped, quoted, and agreed in writing separately before we start, and may be governed by its own project-specific terms. See our Custom Software page for more.

Acceptable use

You're responsible for the content and legality of your own website, what you sell, what you claim, and how you use the contact form and email we set up for you. We reserve the right to suspend hosting for a site that's used for anything illegal, fraudulent, or abusive, and we'll always try to talk to you first.

Liability

We take reasonable, professional care in building and hosting your site, but we don't guarantee 100% uptime, third-party infrastructure, domain registrars, and the wider internet are outside our control. To the extent permitted by South African law, we aren't liable for indirect or consequential losses (like lost business or lost profit) arising from downtime, bugs, or delays, beyond the fees you've paid us for the relevant period.

Intellectual property

You own your business content, your logo, copy, photos, and branding. We own the underlying code, templates, and build tooling we use to deliver Website as a Service, though you're free to take your content elsewhere if you leave. Unless you ask us not to, we may show the finished site in our own portfolio and marketing.

Governing law

These terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act, 2008 and POPIA where applicable.

Changes to these terms

We may update these terms occasionally as our service evolves. We'll update the "last updated" date at the top of this page whenever we do, and material changes will be communicated to active clients.
